Draft urgent ordering for the digitization of the European funds management system

he Ministry of European Funds published on Friday, May 1, 2020, in public consultation, a Draft Government Emergency Ordinance on some measures to digitize the system of coordination and management of European structural and investment funds for the programming period 2014-2020.

According to the draft normative act:

From 1 June 2020, the managing authorities, intermediate bodies and beneficiaries of projects financed by European Structural and Investment Funds of the Large Infrastructure Operational Program, the Human Capital Operational Program, the Competitiveness Operational Program, the Regional Operational Program, the Administrative Capacity Operational Program, The Operational Program for Fisheries and Maritime Affairs, the Operational Program for Technical Assistance, as well as the Managing Authority and the beneficiaries of projects financed from the Operational Program Helping Disadvantaged Persons are obliged to issue, receive and process documents related to project calls, financing contracts / orders / financing decisions, additional documents to them, reimbursement applications, pre-financing applications, payment applications, public procurement files, progress reports, and aa Other categories of documents underlying the implementation of projects only through the computer system SMIS2014 + / MySMIS2014.

The issuance, transmission and processing of documents in letter format is allowed only for their internal circuit and only for situations where there is a legal obligation to archive them in letter format.

Starting with June 1, 2020, the correspondence between the managing authorities, intermediate bodies and beneficiaries will take place only in electronic format, each of the parties being obliged to organize its Electronic Register of Correspondence, but also the electronic archiving of these documents.
